Public Notice – Notice of Passing of a Zoning By-law Amendment By The Township of Addington Highlands

TAKE NOTICE that the Council of the Township of Addington Highlands passed By-law No. 1028/2026 to amend Zoning By-law No. 0212-2006 under Section 34 of the Planning Act, R.S.O 1990, as amended, on May 5, 2026.

PURPOSE AND EFFECT OF THE PROPOSED AMENDMENTS

An application for Zoning By-law Amendment was received from Kevin Smith (P.A Miller Surveying) on behalf of the property owner Marie Alfreda Smith. The purpose of the proposed Zoning By-law Amendment is to satisfy a condition of Consent of Application SEV 2025/07, which requires that the proposed severed lands (lot addition) be rezoned to a Residential Limited Service (RLS) zone.

The property is currently designated ‘Rural Area’ and ‘Waterfront Residential’, with an ‘Environmental Protection’ overlay in the Official Plan and zoned Recreational Commercial (C3) in the Zoning By-law. The Zoning By-law Amendment proposes to place a portion of the property, being the proposed severed parcel, in the Residential Limited Service (RLS) Zone to ensure it is in the same zone category as the lands receiving the lot addition.

LOCATION OF PROPERTY

The property is municipally known as 5617 Weslemkoon Lake Road and is legally described as Pt Lt 30, Con 13, Effingham, as in LA267088, Lying North of Travelled Road, Except Pt 1 to 3 29R8858; Addington Highlands (see key map)

RELATED APPLICATIONS

The lands are subject to consent application SEV 2025/07, which was conditionally approved on October 8, 2025. The subject Zoning By-law Amendment application is a condition of Consent approval. 

WHEN DECISION IS FINAL

The Zoning By-law amendment decision is final if a notice of appeal is not received before or on the date for filing a notice of appeal.

WHEN AND HOW TO FILE AN APPEAL

Any appeal submitted to the Township of Addington Highlands for referral to the Ontario Land Tribunal (OLT) must be filed with the Clerk no later than 4:30 pm on the 25th day of May 2026. The appeal must be received by this date in order to be valid. The appeal must:

  1. Set out the specific part of the proposed Zoning amendment to which the appeal applies;
  2. Set out the reasons for the request for appeal;
  3. Be sent to the address shown below;
  4. Give the name and address of the appellant;
  5. The fee payment required by the Ontario Land- Tribunal (OLT) in the amount of $1,100.00 for payable to the Minister of Finance, Province of Ontario.

WHO CAN FILE AN APPEAL

Any of the following may appeal to the Tribunal by filing with the clerk of the municipality a notice of appeal setting out the objection to the by-law and the reasons in support of the objection, accompanied by the fee charged by the Tribunal:

  1. The applicant.
  2. A specified person who, before the by-law was passed, made oral submissions at a public meeting or written submissions to the council.
    1. A public body that, before the by-law was passed, made oral submissions at a public meeting or written submissions to the council.
    1. The registered owner of any land to which the by-law would apply, if, before the by-law was passed, the owner made oral submissions at a public meeting or written submissions to the council.
  3. The Minister. 

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
